As vÃ¡rias ediÃ§Ãµes publicadas em FranÃ§a, na Alemanha e em ItÃ¡lia, assim como as Â«AdditionesÂ» Ã  obra de Molina, publicadas em FranÃ§a, corroboram que o debate legal em torno dos morgadios ia alÃ©m da PenÃ­nsula IbÃ©rica. Caso notÃ¡vel que demonstra a vitalidade da obra, foi a sua utilizaÃ§Ã£o como fonte para a elaboraÃ§Ã£o do CÃ³digo Civil chileno de 1855, por AndrÃ©s Bello.\u003c\/p\u003e\n\u003cp\u003eÃ‰ importante notar que existe uma confusÃ£o frequente entre Luis de Molina y Morales, o autor do presente tratado, e o teÃ³logo jesuÃ­ta Luis de Molina, que viveu no mesmo perÃ­odo. O jurista Luis de Molina y Morales nasceu em Osuna, na Andaluzia, enquanto o teÃ³logo Luis de Molina nasceu em Cuenca. O teÃ³logo Ã© conhecido pela sua obra sobre a graÃ§a e o livre arbÃ­trio,Â«Concordia Libri Arbitrii cum Gratiae DonisÂ», um trabalho fundamental na histÃ³ria do pensamento teolÃ³gico. A confusÃ£o entre estes dois autores Ã© comum, mas as suas Ã¡reas de especializaÃ§Ã£o e as suas obras sÃ£o distintas.\u003c\/p\u003e\n\u003cp\u003eA primogenitura, ou seja, o direito do filho mais velho a herdar a maioria ou a totalidade dos bens da famÃ­lia, foi um mecanismo que desempenhou um papel vital na estrutura social e econÃ³mica da Ã©poca. Os morgadios, por sua vez, foram instituiÃ§Ãµes que funcionavam como uma forma de vinculaÃ§Ã£o de bens, assegurando que um determinado patrimÃ³nio, geralmente terras, edifÃ­cios e outros ativos, fosse transmitido integralmente a um Ãºnico herdeiro. Este sistema visava manter a integridade do patrimÃ³nio familiar ao longo das geraÃ§Ãµes, preservando a riqueza e o estatuto social da famÃ­lia.\u003c\/p\u003e\n\u003cp\u003eOs morgadios em Espanha, conhecidos como mayorazgos, surgiram na Idade MÃ©dia e foram formalmente regulamentados no sÃ©culo XIII, nas \u003cem\u003eSiete Partidas\u003c\/em\u003e de Afonso X, o SÃ¡bio (1256-1265). As primeiras instituiÃ§Ãµes de morgadio, em Portugal, datam do inÃ­cio do sÃ©culo XIV. Durante os duzentos anos seguintes, nÃ£o existe qualquer tradiÃ§Ã£o de escrita sobre a vinculaÃ§Ã£o. Apenas no sÃ©culo XVI surgem, em Castela, as primeiras obras de literatura jurÃ­dica prÃ¡tica, datando de 1537 o clÃ¡ssico de Luis Molina y Morales Â«De hispaniorum primogeniorum origine ac naturaÂ». Em Portugal, somente nas Ãºltimas dÃ©cadas de Quinhentos comeÃ§am os praxistas a publicar as sentenÃ§as dadas nos tribunais relativas a morgadios. A obra de sÃ­ntese aparecerÃ¡ muito mais tarde: o Tractatus de exclusione, inclusione, successione et erectione maioratus (1685), de Manuel Ãlvares Pegas.\u003c\/p\u003e\n\u003cp\u003ePara alÃ©m de garantirem a perpetuaÃ§Ã£o do patrimÃ³nio familiar, os morgadios estabeleciam uma ligaÃ§Ã£o complexa com a Igreja atravÃ©s de obrigaÃ§Ãµes pias, construÃ§Ã£o de capelas e apropriaÃ§Ã£o de prÃ¡ticas religiosas, que serviam tanto para a salvaÃ§Ã£o das almas dos fundadores como para a afirmaÃ§Ã£o do poder e prestÃ­gio das linhagens. Por vezes, a Igreja, nas suas diferentes formas, como mosteiros e ordens religiosas, era por vezes chamada a administrar os bens do morgadio, assegurando o cumprimento das obrigaÃ§Ãµes pias e a continuidade da instituiÃ§Ã£o.\u003c\/p\u003e\n\u003cp\u003e\u003cstrong\u003eLuis de Molina y Morales\u003c\/strong\u003e (Osuna, Andaluzia, ca. 1520 - Madrid, ca. 1581) foi um jurista influente. Nasceu numa famÃ­lia da pequena nobreza: o seu pai, Luis de Molina, era governador do castelo de Archidona, que pertencia Ã  famÃ­lia GirÃ³n (duques de Osuna), e a sua mÃ£e, Cecilia de Morales, era irmÃ£ do famoso cronista real Ambrosio de Morales. Casou-se com Susana Ovalle, com quem nÃ£o teve filhos.\u003c\/p\u003e\n\u003cp\u003eEstudou Direito CanÃ³nico nas Universidades de Osuna e Sevilha, em 1547, e JurisprudÃªncia em Salamanca, onde foi aluno do mestre Peralta e se doutorou em Direito. Advogado de renome em Madrid, foi incorporado no serviÃ§o pÃºblico como procurador das Reales Razones, responsÃ¡vel pela custÃ³dia dos monumentos. Posteriormente, integra o Conselho das Ãndias como procurador da sua ContadurÃ­a Mayor (1564 - 1572). A sua missÃ£o polÃ­tica mais importante foi a comissÃ£o que realizou juntamente com o sevilhano VÃ¡zquez de Arce, por ordem de Filipe II, perante o cardeal D. Henrique, rei de Portugal, para defender os direitos do rei espanhol ao trono portuguÃªs, da qual deixou um importante documento de carÃ¡cter jurÃ­dico. O Ãªxito da missÃ£o foi recompensado com a sua promoÃ§Ã£o ao cargo de conselheiro do Conselho de Castela.\u003c\/p\u003e\n\u003cp\u003eO seu estatuto de jurisconsulto de excecional valor jÃ¡ era reconhecido no seu tempo, com menÃ§Ãµes elogiosas de autores espanhÃ³is (Covarrubias, Juan GarcÃ­a, Morales, etc.) e internacionalmente, graÃ§as Ã  fama alcanÃ§ada pela sua obra De Hispaniorum Primogeniorum.\u003c\/p\u003e\n\u003cp\u003e\u003cstrong\u003eBaltasar GilimÃ³n de la Mota\u003c\/strong\u003e (Medina del Campo, c. 1547 â€“ Madrid, 1629), de famÃ­lia nobre, estudou Direito na Universidade de Valladolid, tornando-se advogado da Chancelaria dessa cidade em 1585. Iniciou a sua carreira como oficial pÃºblico em 1608, quando foi nomeado fiscal do \u003cem\u003eConsejo de Hacienda\u003c\/em\u003e. GilimÃ³n foi um fiel protegido do Duque de Lerma, o que lhe permitiu ascender a fiscal do Conselho de Castela em 1612. Mais tarde, em 1616, foi nomeado conselheiro de Castela. Em 1626, foi designado para presidir o \u003cem\u003e\u003cem\u003eConsejo de Hacienda\u003c\/em\u003e,\u003c\/em\u003e embora com o tÃ­tulo de \u003cem\u003econtador mayor de Cuentas\u003c\/em\u003e. JÃ¡ no fim da vida, a 3 de setembro de 1629, foi nomeado membro do Conselho de Estado. Casou com Gregoria de Vega, com quem teve oito filhos.\u003c\/p\u003e\n\u003cp\u003e\u003cstrong\u003eAntonio de la Cueva y Silva\u003c\/strong\u003e (Medina del Campo, 15--? â€“ Madrid, 1626), irmÃ£o da poetisa Leonor de la Cueva y Silva, foi catedrÃ¡tico na Universidade de Valladolid e advogado pela AudiÃªncia e Chancelaria Real de Valladolid. Estabeleceu-se em Madrid, onde tambÃ©m exerceu advocacia nos Reales Consejos. Em 1621, desempenhou o cargo de fiscal na \"junta que trata del negocio de Carlos PerÃ³n\". Em 1624, foi nomeado fiscal do Conselho de Ãndias, cargo que exerceu atÃ© Ã  sua morte. Sometimes the Church, in its different forms such as monasteries and religious orders, was called upon to administer the \u003cem\u003eMayorazgos\u003c\/em\u003e and \u003cem\u003emorgadios's \u003c\/em\u003e assets, ensuring the fulfilment of pious obligations and the continuity of the institution.\u003c\/p\u003e\n\u003cp\u003e\u003cstrong\u003eLuis de Molina y Morales\u003c\/strong\u003e (Osuna, Andalusia, ca. 1520 - Madrid, ca. 1581) was an influential jurist. He was born into a family of minor nobility: his father, Luis de Molina, was governor of the castle of Archidona, which belonged to the GirÃ³n family (dukes of Osuna), and his mother, Cecilia de Morales, was the sister of the famous royal chronicler Ambrosio de Morales. He married Susana Ovalle, with whom he had no children.\u003c\/p\u003e\n\u003cp\u003eHe studied Canon Law at the Universities of Osuna and Seville in 1547, and Jurisprudence at Salamanca, where he was a pupil of Master Peralta and obtained a doctorate in Law. In 1624, he was appointed fiscal of the Council of the Indies, a position he held until his death.
